Due to degrading levels of groundwater day by day central ground water authority of India has made it mandatory of all kinds of Industrial plants, Infrastructure and mine projects to get NOC for ground water abstraction. To regulate the ground water abstraction central ground water authority was constituted under the environmental protection act 1986 sub-section 3 of section 3.
CGWA has been authorized with some of the following powers and functions
1. Authority has power to penalize companies and infrastructure projects who are using ground water without NOC.
2. Authority has right to exercise of powers under section 5 of the Environment Protection Act, 1986 for issuing directions and taking such measures in respect of all the matters referred to in sub-section(2) of section 3 of the Environment Protection Act, 1986.
3. The major function of the authority is to regulate and control the usage of ground water and authority is working towards augmentation of ground water level.
i. Consent to Operate (Consent to Establish if CTO not available) or Environmental Clearance if applicable.
ii. Only self declaration of Certificate of water availability/non availability from government water supplying agency.
iii. Proposal only for Roof Top rainwater harvesting / artificial recharge.
iv. Authorization letter from firm.
v. Scanned copy of application with signature and seal.

iii. Proposal for rainwater harvesting / artificial recharge. In case, the water harvesting / artificial recharge structure is proposed to be constructed outside the area of the industry, NOC is required from that agency/ authority where the structure is proposed. Dimension of pond should mention in NOC.
iv. Ground water quality report of existing tube well.
v. Authorization letter from firm.
vi. Scanned copy of application with signature and seal.

Step 1: Collection of all supporting documents according to the category of ground water abstraction limit.
Step 2: Submission of application online on the CGWA web portal.
Step 3: Submission of signed hard copy of the application along with all documents and rain water harvesting proposal.
Step 4: Issuance of NOC by CGWA.
1. Collection of the documents.
2. Drafting and submission of proposal.
3. Offline submission of proposal to CGWA.
4. Follow-ups with the authority.
5. Reply to queries raised by CGWA
6. Ground water quality report.
7. Lithological log of the bore well by drilling the bore in the premises.
8. Final NOC from CGWA to abstract ground water.
The maximum processing time for the NOC is three to Ten Months. After getting NOC first time, NOC needs to be renewed within 2 years of time period and after that every 3 to 5 years depending on the conditions given in the NOC. In case if any company or infrastructure or mining projects are using ground water without NOC shall be liable to pay Fine as wells as Environmental Compensation/Damages
