State pollution control boards are implementing different kinds of environmental legislations in the respective states, mainly including Water (Prevention and Control of Pollution) Act, 1974, Air (Prevention and Control of Pollution) Act, 1981, Water (Cess) Act, 1977 and some of the provisions under Environmental (Protection) Act, 1986 and the rules framed there under like, Biomedical Waste (M&H) Rules, 1998, Hazardous Waste (M&H) Rules, 2000, Municipal Solid Waste Rules, 2000 etc. MPCB is functioning under the administrative control of Environment Department of Government of Maharashtra.

For any company it is mandatory to get pollution compliance NOC to establish or to operate the company. The board authority manages and regulates the various pollutions by closely monitoring the emissions, wastes disposals of the company.

Consent form is categorized in total five sections as follows-
1. General Information section.

This includes general information about the company like contact details, Name and location of Industrial unit etc.

2. Waste Water Aspects

This section covers the waste water generated through the process i.e. effluent and sewage.

3. Air Emission aspects

Here in this section air pollution related aspects are covered this includes stack height of the chimneys and composition of the gases emitted throughout the processes.

4. Hazardous Waste Aspects

Some processes may generate hazardous wastes from the processes that needs to be covered under this section.

5. Additional Information

Documents required for consent to establish (CTE):

1. Site plan/index.
2. Topographical Map.
3. Detailed layout plant of different processes and point sources of effluent. discharge/emissions and position of stack and documents including D.G. set capacity in KVA.
4. Process flow sheet.
5. Details of Water Pollution Control/Air Pollution Control devices proposed to be provided.
6. Ambient Air Quality Report (if available)
7. SSI Certificate/NOC from Directorate of Industries Government of Maharashtra.
8. D.G.T.D. Registration. (if applicable )
9. Details of chemical reactions with mass balance.
10. Consent fees in the form of D.D. drawn on favor of MPCB.
11. Local body NOC.
12. Under taking on Rs. 100 stamp paper or Chartered Accountant certificate about proposed Capital Investment ( Land, building, and machineries.

Documents required for consent to operate or Renewal of CTO:

1. Detailed layout plant of different processes and point sources of effluent discharge/emissions and position of stack and documents including D.G. set capacity in KVA.

2. Process flow sheet.

3. Latest analysis report of effluent, fuel gases, solid waste & hazardous wastes.

4. Details of Water Pollution Control/Air Pollution Control devices provided.

5. Ambient Air Quality Report (if available)

6. SSI Certificate/NOC from Directorate of Industries Government of Maharashtra.

7. D.G.T.D. Registration. (if applicable )

8. Details of chemical reactions with mass balance.

9. Consent fees in the form of D.D. drawn on favor of MPCB.

10. Xerox copy of previous consent (for renewal only).

11. Xerox copy of Environmental Clearance of Government of Maharashtra or Government of India in case of 1st consent to operate in case of industries/process requiring environmental clearance.

Procedure to get Consent to Establish (CTE) OR Consent to Operate (CTO):

Step 1: Registration on Pollution control board web portal.

Step 2: One-time mobile verification for the applicant & one-time online document verification by the Department as a part of the registration procedure.

Step 3: Updating all the information in the consent form as per upper mentioned sections.

Step 4: Uploading the four compulsory documents on the portal.

Step 5: Payment of consent fees as per the pollution control board norms and updating of the payment status on the portal

Step 6: Site Visit by the field officer which is assigned by the SRO.

Step 7: Now depending upon the category and the Capital Investment of the industry the application is forwarded through IMIS as per delegation of power. The concerned authority will scrutinize the application, if it is fine then the application is granted in IMIS and then status will be changed to "Approved" on the online portal followed by uploading the signed consent copy. Otherwise if the application is not fine, then the application is rejected in IMIS and notifies the applicant by marking the application status as "Rejected". Industry can download the consent copy from online portal.
